The company offers products and services ranging from concealers, foundation, finishing powder, lipbalm , lipstic, makeup removal, mascara, eye-brow-pencil, and many other products. The company was established by two individuals who thought they could be a good competition for the MAC cosmetic line. Hence they partnered together and created this growing cosmetic company and hope to achieve its goals and objectives through good management, good marketing and having a good promotion body. Miracle Obsession is a company that promotes their products and services through different medias such as (social medias) Facebook twitter and other medias such as newspaper, television, and magazines. To conclude miracle Obsession business profile the company works towards maintaining competitive advantage over it competitors and continues to be one of the leading cosmetic companies in Jamaica. According to Denning (2009), knowledge is the factor condition of knowing something with familiarity gained through experience or association. An understanding of knowledge requires some grasp of its relationship to information. The human mind is often seen as being capable of two kinds of knowledge the Rational and the Intuitive. However Kennerly (2008),stated that organizations today have access to almost unlimited amounts of data-sales , demographics, economic trends competitive data, consumer behavior, efficiency measures, financial calculation ,etc. However, many decisions makers in organizations feel lost and perplexed. The researcher intends to conduct a qualitative research in providing that information about the importance of a valid contract and the effects of the different elements of a contract. Therefore interviews will be used as the primary research approach. The researcher anticipates in conducting interviews with at least two different representatives that major in law. All interviews therefore will be taped record and are expected to endure for up to fifteen (15) minutes. Learning theories Essay
Learning and development theories are conceptual frameworks that are looked at how information is absorbed, processed and retained during learning. Through using different learning theories you are able to teach children in the classroom and develop and strengthen them as a person not only intellectually but socially as well. Theories provide information that can help teachers influence childrenââ¬â¢s learning by providing developmentally appropriate practice. In practice theories help to improve, enable, inform, provide for and explain, but too many theories can create a very confusing picture. Neuroscientists believed that the genes we are born with determine the structure of our brains and that with the fixed structure determines the way we develop and interact with the world. However it has since been proven that itââ¬â¢s not the case at all and that we are only born with the framework and what we put inside this framework is completed over time and completely our own choosing. Carol Dweck, who is widely known as one of the worlds leading researchers in the field of personality, social psychology and developmental psychology, believes that everyone has a growth or fixed mind-set. She believed that if you have a fixed mindset you would only achieve what you think you are good at. People with a fixed mindset are usually ââ¬Ësmartââ¬â¢ but wonââ¬â¢t challenge themselves anymore if they think they may fail at something. Where as with a growth mindset they will challenge themselves and stretch their brains and achieve goals they at first found challenging. ââ¬Å"So children with the fixed mindset want to make sure they succeed. Smart people should succeed. But for children with the growth mindset, success is about stretching themselves. Itââ¬â¢s about becoming smarterâ⬠(Dweck, 2012:17). During placement I witnessed and followed the learning theories of Carol Dweck. Growth mind-set was widely used in the Year 2 classes and children were thinking about and developing their own learning. There was a display on the wall where each child had written their own learning challenge down on how they were going to grow their own brains. These were displayed at the front of the class where the children could read them everyday. I found this to be very inspiring as the children set their own learning challenge and reflected on this quite often to see how they were developing towards their own learning challenge. They had a challenge mountain and when a child was progressing towards their learning challenge they would climb the mountain. The children completing this were only six and seven years old. The challenges might of only been something as small as ââ¬Ëlearn to write smallerââ¬â¢ or ââ¬Ëuse finger spacesââ¬â¢ but these were challenges that they needed to develop in order to help them progress with their own learning challenges. ââ¬Å"People in a growth mindset donââ¬â¢t just seek challenge, they thrive on it. â⬠(Dweck, 2012:21) Children in the year two classes could make the choice of challenging work or work they knew they would find easy. The children responded well to this by wanting to complete the more challenging work and you would hear them say they wanted to ââ¬Ëgrow their brainsââ¬â¢. This was really pleasing to see as you could see children who wanted to learn and wanted to grow their own mindset. The children were more positive about their own learning and really enjoyed challenging themselves in order to grow their own brains. There were the children however that didnââ¬â¢t think they needed to challenge themselves as they already thought they were smart enough and knew everything. These children really didnââ¬â¢t like it when they were wrong and really saw themselvesà as a failure to the point they would get upset. This really reflected what Carol Dweck had said about fixed mindsets and how they see themselves as failures unlike growth mindset where they would just learn from it and see it as a challenge of how they can improve their work next time. This is something the children would do at the end of each lesson. They would write themselves a challenge at the bottom of their work of how they would improve their work next time. ââ¬Å"Entity theorists (fixed mindset) are performance and achievement oriented, and so they personalise failure, blaming their own lack of ability. In future, their mindsets say, avoid any situation in which you might fail, as you will no longer look clever. They will therefore become risk-adverse in their learning, choosing options which are easily attainable so that they can continue to define themselves as clever. Failure undermines motivation for these students and achievement-related praise will only reinforce this self view. â⬠(Robins, 2012:55). In subjects the fixed mindset children had seen previous failure, you would see them become much quieter and fade into the back ground unlike lessons they would know they achieve more in. The difference between the fixed and growth mindset children was that the growth mindset children would throughout any lesson thrive to learn and challenge themselves even if they did make mistakes. They would be the ones answering questions even if they were unsure of the answer and challenging the teacher with their own challenging questions. The fixed mindset children would only answer questions they definitely knew the answer too. At the end of each lesson children would mark their own work using the success criteria they had created as a class, and then set themselves a challenge to help toà improve the work they had completed. This is something that has been inspired by the work of Shirley Clarke and her formative assessment work. The work of Shirley Clarke and Carol Dweck both work well together in the classroom and go hand In hand with the development of children and their own growth mindset. With the influence of Shirley Clarke and assessing your own work and then with Carol Dweck and thinking about how you could improve and grow your brain by improving the work you have completed. These two theories really reflected the overall work that the children had completed and the results were really inspiring to see. For some children they found this easy to set themselves a challenge, but for some they found it quite difficult as they would think their work doesnââ¬â¢t need improving. This is when you could see the fixed mindset children in the class. The children who already thought they were smart enough. The only down fall I found with the children writing their own challenges for their work was that they never got to act upon this challenge that they had set themselves all the time. The work would be completed but then never reviewed for improving this with the challenge they had setà themselves. One thing I did when I was teaching a lesson and I got them to write their own challenges was I got them to relook at their work and review the challenge they had written down at the start of the next lesson. This then really got the children to stretch their brains as they were actively improving their own work. The growth mindset is something I would take forward with my teaching career as I find it very inspiring that children are able to set their own challenges In order to grow their own brains. Doing this right and inspiring the children to think with the growthà mindset can really help children to develop more than they thought they could. I wish this was something that I had been introduced to in primary school as I may of challenged myself more and wouldnââ¬â¢t of not completed work I found to be too ââ¬Ëhardââ¬â¢ for myself to complete. Going forward I set myself the challenge of reading and researching this theory more and going forward onto my next placement think of ways I could slowly introduce this when I am teaching a class and see if the results really do reflect how I feel this theory does work. Behaviourism is another theory that is widely used with in primary schools day in andà day out. Behaviourism (which is also known as stimulus-response) is based upon the simple notion of a relationship between a stimulus and a response, which is why behaviourist theories are often referred to as stimulus-response theories. Behaviour can be controlled with rewards and sanctions, rules or expectations and the role of the teacher and their own behaviour. Behaviourist experts such as Bruner, Skinner and Pavlov all have different theories of controlling behaviour and these have been used within a classroom environment. ââ¬Å"In Pavlovââ¬â¢s famous experiments, when a bell rang, dogs salivated. Your pupils almost do the same. When the bell rings they instinctively pack up and try to leave the classroom, leading to the classic teachersââ¬â¢ phrase ââ¬Å"the bell is for me and not for youâ⬠(TES (2014) Pavlov was born1849; his primary interests were the study of physiology and natural sciences. Pavlov used routine and using a bell with dogs to train them when it was time for their dinner. With this the dogs in time learned to salivate at the sound of the bell without even having to see the food in front of them. This is the same within a school environment to a certain degree. Children are taught that the whistle or bellà used in the play ground in the morning is the start of school. That each bell after that is a different time of day such as break time, dinner time, afternoon break or the end of school. You would have the children in year 2 asking you if it was 10. 40am yet. This is because even though they couldnââ¬â¢t tell the time properly they knew that at 10. 40am it was break time as this was something they had been told by the teacher. Children are taught routine of a the school week by using a diagram displayed as they come into the class in the younger classes, to the children in older classes knowing the school day by remembering. For example they might know that on a Monday that they start with the register, then its assembly, phonics, etc. With this children know the routine of the day and week. The only thing with this is that when the routine changes the children can become confused. During the week they had their Christmas rehearsals the children really couldnââ¬â¢t understand why they were not completing their normal subjects of phonics or literacy etc. Skinner was born1904 and was influenced by the work of Pavlov. He took what Pavlov used and influenced the use of rewards and sanctions to reinforce positive behaviour. ââ¬Å"Skinner maintained that rewards and punishments control the majority of human behaviours, and that the principles of operant conditioning can explain all human learningâ⬠(Pritchard,2014). In the class of year two, they would be rewarded with their names on the smiley board if they were well behaved. You could see the children eager to get their names on the smiley board as after three ticks would result in the children having a visit to the head teacher. This was positive in the sense the children knew that with good behaviour and hard work they would be rewarded. The use of stickers is only a smallà thing to an adult, but to children they are really happy to receive one for good behaviour and will show everyone who will look what they have received. I could also see the negative to this as well. The use of the smiley and grumpy board wasnââ¬â¢t always used to the best advantage. Some children would display the same behaviour as someone who had previously got their name on the board but then wouldnââ¬â¢t be rewarded the same way. For some children this then lacked the incentive to behave in the way they should and would become less interested. Rewards and sanctions need to be consistent in order to have the impact a teacher wants toà manage the behaviour and learning within the classroom. After seeing this on the first six weeks of placement I decided I needed to change the way in which I managed the behaviour of the children on my return for the last two weeks. ââ¬Å"Skinner argued that if pupils were consistently praised (positive reinforcement) for learning or behaving in a certain way; they would behave in the same way again, thus creating ââ¬Ëconditions which are optimal for producing the changes called learningââ¬â¢ and allowing the teacher to influence the behaviour of pupils at will without resorting to punishmentâ⬠. (Robins, 2012:22) There was a seminar on behaviour management in the gap between placements and we were shown a video of an outstanding teacher displaying different positive techniques for controlling behaviour. He would praise good behaviour and also reinforce expectations if they were not being followed. I found this very inspiring as the teacher himself had a positive influence on the children and their behaviour not only towards him, but throughout taught lessons. I actually stole some of the techniques he had displayed and made them my own. When returning to placement I was given the challenge of teaching the other yearà two class, which had a lot of lower ability and fixed mindset children in. I had a range of rewards and sanctions to help me manage the behaviour of the children. Buttons in the jar was a huge success as children really responded to the idea of a team effort and filling the jar up with buttons as a class rather than just an individual reward. Rewards need to have value to children otherwise there really is no point in them trying to achieve something they donââ¬â¢t really want. I asked the children what it was they would like to receive as a reward at the end of the two weeks. This was aà much better response and throughout the two weeks the children really worked together to collect the buttons in the jar. With this I wasnââ¬â¢t only rewarding the best in the class but also the children who had tried their hardest or had worked well with their talk partners. At the end of each lesson I would then reward these children with a raffle ticket. The more raffle tickets they collected the better the chance they had of winning a prize. This gave the element of chance to the children, meaning that even if you only had one raffle ticket you was still in with a shot of winning the prize. Thisà really got the children involved and throughout the two weeks the improvement in the behaviour had dramatically changed. The children would respond to me much quicker when I wanted them to look and listen to me and the way they worked together changed as well. They would really praise each other and if someone won a raffle ticket you would hear the rest of the class praising that child for their reward. Using these techniques really helped me to be seen as a teacher statues on placement and this is something I would moving forward really concentrate on, whether itââ¬â¢s on my next placement or in my teaching career. Behaviourism is something that has really helped teachers control and manages the class in which they are teaching. With the use of rewards and sanctions and positive reinforcement it is very clear to see that children will respond better and the learning will improve as children are much more positive towards their own learning. Following on from this I would like to set me the targets of researching and observing theories used within the classroom. This will not only ââ¬Ëgrow my brainââ¬â¢ on learning theories but will also strengthen me as a teacher going forward into my teaching career. I will have a better understanding of the learning styles of children and be better able to tackle the challenges teachers face everyday. In the heat of the moment, these students are not thinking logically. These students think they have to do well on tests and that cheating is the best way to do it. These risky students are not thinking about the consequences if they get caught. In addition, these students are not thinking of the fact that they should be studying instead of playing video games all night. For example, a friend cheated all the time on tests. What he didnââ¬â¢t know was the teacher knew all along. At the end of the semester, the teacher showed him a list of zeros and said, ââ¬Å"Next time, STUDY! â⬠The students of todayââ¬â¢s society are expected to be more productive with their time because of higher educational demands. That doesnââ¬â¢t mean wasting time by staying up all night playing video games or partying or doing other things that do not include studying. They would rather do nothing, cheat and risk getting caught! Another key point is that there are students that take cheating to the next level. In other words, some students are so desperate they are willing to steal test answers. Also, some students will go as far as hiring someone else to take the test for them. What these students fail to realize is that stealing test answers or hiring someone to take the test for them is a felony. For example, there was a segment on the television about a seventeen year old boy being hired to take the SATââ¬â¢s for other students. Apparently, the boy got caught, and is now under house arrest. In addition, he has to do years of community service. On top of that, he has a record so it will be difficult for him to get into a good college or, ultimately, get a decent paying job. This shows how far cheating can go and that sometimes it may ruin oneââ¬â¢s future which could even affect and ruin more than just one personââ¬â¢s life. The importance of education and the curriculum demands have gotten higher over the upcoming years. Unfortunately, this has caused students to turn to cheating. In the end, cheating has caused students to lower their standards of themselves. These students are risking everything by cheating. The reason being that college or university graduates have had at least two years of independence, where students have to responsible for their grades as well as attending classes. High school graduates do not have access to this type of environment, where young people learn rom experience how to manage their time effectively, where they can afford to make some mistakes. High school graduates have to learn from their mistakes in the real world, where mistakes can be more costly. They also feel responsible to the farmers they buy coffee from. Therefore, I think they maintain ethics in sourcing the coffees from different sources. They also maintain ethical approach while dealing with the government of different countries(Dane and Sonenshein 2015) As the coffee industry is going through a crisis by over production, they are trying to save farmers who have higher productions. Starbucks also takes care of the community they belong in different country by providing education and en vironment development programs for the nonprofit organization. It is not just a Public relation stunts, their ethical sourcing also includes global alleviation of farmers economic situation (Watts et al. 2017). They also help in fair price trade of the farmers. Environment friendliness is also part of their corporate social responsibility strategy. The initiation to build a farmer support center shows their commitment to the farmers of Costa Rica. The profit from the premium price of their coffee boils down to their farmers so that they can keep the firm business running. They aim to demonstrate that that their core value includes profitability as well as social responsibility of the company (Watts et al. 2017). It has also build this brand based on the social image of the company. Starbucks CEO Howard Schultz on Social Responsibility Howard Schultz, the CEO of Starbucks highlights the value they always relied upon while doing the business. Not just making profits, but giving something back to the community has always been the motive of the company (genConnect, 2013). After going public in 1992, they also have taken care of the shareholders and equity holders (genConnect, 2013). Taking care of all the direct and indirect stakeholders of the company has driven them to initiate new programs and supporting facilities in the company(Ferrell and Fraedrich 2015). The employers always seem happy and taking care of them was also main characteristics of Starbucks. As told by the CEO, the budget deficit of American states is staggeringly low therefore, it must be considered by business people in the country and they must come forward to help the community to improve. They have also faced challenges in building this reputation in the community as well as seek social reputation. The shareholders are also happy with the public relation they maintain. The only way you can create value for your shareholders is to create value for your people, this is also a main mantra they have abide by over the years (genConnect, 2013). According to the CEO, the social services should be recognized by people and thus must lead to improvement, it also achieves the target of the reaching desired goal of increasing bottom line. Collective achievement plan is what they focus on while helping the people in the company to develop their career and economic health. Their commitment to employment opportunities is effective for growing for ambitious people. Thus it also helps in creating value addition for the shareholders. Their social value considers ethical sourcing, environment friendliness and building value for all stakeholders in the company(Dane and Sonenshein 2015)Corporate social responsibility of Starbucks incudes sustainability and regulatory compliance in operating different country. Thus it is one of the most importa nt thingin social compliance (Watts et al. 2017). The statutory requirement goes beyond the social responsiveness of the corporates. The ethical consideration is one of the most important part of CSR policies. Issues in financial and accounting fraud The financial aspect of business is one of the most critical part of business. There have been cases where this aspect of business has faced rather ethical confusions. This matter has destroyed different giant corporation like Enron and Arthur Anderson. It is not that this people wanted to commit this fraud while remaining in the system, but there was some situation that contributed to this fraudulent. The financial situation of the people is one of the main feature that has contributed to this situation(Ferrell and Fraedrich 2015). The pressure, opportunity is the beginning of this frauds in the company. The unethical approaches only come when the company are not able to make proper profits and the people there are pressurized generate profits. The main criteria of the e=public companies to generate proper revenue based on the analysts prediction. Thus the companies find itself in unfavorable situations. If the companies perform less than that is expected, then they lose shareholder s base in the company (Drumwright et al. 2015). According to the speaker, the main reason for the company to fall in this unethical pattern, is that there focus into the short term profit as well as the reflecting in the analysts expected results. Thus it can be said that the people in the corporation must be guided by the CFO, who can develop ethical standards in the company. The employer should keep those in mind. A long term view of things also must be considered in the company. Keeping the volatility of the market in mind, the main goals and values of abiding by the ethics should be kept in mind (Drumwright et al. 2015). According to my view in the subject, alleviation of the fraud free culture in the organization is needed for companies. The regardless character of the company should also be promoted. A regardless character is a no go from the time of hiring. The financial prospect also lies in the hand chief financial officer. Doing the right thing, but being smart about it is a key thing that should be main motive (Markkula Center for Applied Ethics at Santa Clara University, 2014). Overall, ethics should be maintained in all operations, that includes the financial functions of the company. The main criteria of maintaining high ethics and high integrity is one of the most important factor that should be incorporated in the companys hierarchical level (Drumwright et al. 2015). That will boil down to other mid and junior level of the company. The responsibility to put the proper standards of ethics should be written. This will be communicated to the employees during the time of induction. Government legislations cannot be only thing to depend on. Their presence has become most important part in the world of trade. They are also accused of major bribery scandal, which they have denied. A sacred place of Mexico was destroyed in order to build the supermarket, which now only dominates the people in the market. The expose on the article of Wal-Mart Mexico is one of the most important foreign subsidiary of its parent company of Wal-Mart (Democracy Now, 2012). Whenever a company wants to expand, it should be taken into consideration of the religion, and ethical attitudes of that place, which Wal-Mart ignored in Mexico. Moreover, they committed a crime while bribing the then Mayor of Mexico. Though it can be passed as facilitating payments, nonetheless it is a crime. The code of conduct in business prohibits this practice in US as well as Mexico(Goetschand Davis 2014). This infiltration of ethical approaches has been committed by the particular lawyer in the company . When the investigation started, reasonable evidences were there, that the bribery has been done in initiating the project in the city. As a large corporation the, Wal-Mart though started an investigation, they handed the case to a general council of Mexico. This is where another unethical part committed by Wal-Mart begins. As the councilor was one of the prime suspect of the investigation done by US veteran (Democracy Now, 2012). Wal-Marts focus on this community was very important as Mexico became a foreign hub for Wal-Mart. In many countries bribery is considered to bring economic efficiency. Though there are many perspectives that can be discussed in Wal-Marts Bribery case, as the increase in employment in Mexico (Democracy Now, 2012). The main focus of this is the zoning community wanted to keep the alpha alpha ground of the pyramid undisturbed. The emotion associated of this Mexican community should have been taken into consideration. This unethical approach also ruined this giant corporations identity as well(Ferrell and Fraedrich 2015). Moreover, the loss of heritage of the community were also avoided, in Wal-Marts aggressive approach to build a supermarket. The corruption policy of Mexico was also a dilemma. The bribery case only happened because the code of conduct and ethics are not in practice in Wal-Mart. This leads to fall of different giant corporations fall. The short term profit gain motive led people to do such things, which should be avoided by strong hold of corporate governance (Drumwright2015). The Rise and Fall of Arthur Andersen Arthur Anderson was an accounting firm of Chicago, which became a brand in the industry. They also started doing business with integrity. Such values and ethics were integral part of Arthur Anderson. They were in business with different firms handling their accounting and financial aspects and earned a name among the big five accounting firm all over the world. In the late 1980s they expand their business in the consulting firm (Nick Lodato, 2012). This division wanted to separate themselves as a result the employees were pressurized to make huge profits for the firm. Thus they got involved in unethical approaches and started to making fraudulent accounts, false report and book keeping accounts. The main weakness of the company was in its strategic decision making to expand without having proper backup. It also got involved with the corporate giants who failed to abide by proper code of conduct. Accounting irregularities and fraudulent details of the company were accepted in abundant (Goetsch and Davis 2014). The previous corporate culture of the company was transparent, which made it possible for the company to be part of the Big Five firms. The main reason of the downfall of Arthur Anderson started when they started accounting fraud for Enron and Sunbeam. This two company was also a part of the downfall of the company. The corporate culture was infiltrated to the level of companys policies. In this case, short term gain and aggressive expansion strategy were one of the most important factor that should have been avoided (Drumwright et al. 2015).
